 NOTICE OF PUBLIC HEARING

Notice is hereby given that public hearings will be held in the City Council Chambers of the 2nd floor of the Butler City Hall located at 22 West Ohio, Butler, Missouri 64730 by the Butler Planning and Zoning Commission at 5:30 p.m. on Tuesday, May 8th, 2018 and by the Butler City Council at 7:00 p.m. on Tuesday, May 15th, 2018 for the following matter:

• A Conditional Use Permit has been applied for by Schowengerdt Funeral Chapel, Inc., owned by Gary and Trevalyn Schowengerdt. The request is for the building of a crematory in a C-3 zone in accordance with Sec. 26-136 of the Butler, MO Code of Ordinances.
• Legal Description: Tract III--That part of the Southeast Quarter of the Southwest Quarter of Section 10, Township 40 North, Range 31 West of the 5th Principal Meridian in Butler, Bates County, Missouri described as follows: Commencing at the Northeast corner of said Quarter Quarter Section, thence on an assumed bearing of North 89 degrees 42 minutes 30 seconds West along the North line of said Quarter Quarter Section a distance of 596.89 feet to the point of beginning of the land to be described; thence continuing on North 89 degrees 42 minutes 30 seconds West a distance of 157.42 feet; thence South 00 degrees 17 minutes 15 seconds West a distance of 200.00 feet; thence South 89 degrees 42 minutes 30 seconds East a distance of 157.42 feet; thence North 00 degrees 17 minutes 15 seconds East a distance of 200.00 feet to the point of beginning. Subject to all easements of record.
• The property address is 1309 N Orange Street, Butler, Missouri 64730.

Zoning Board of Adjustments

The Butler Zoning Board of Adjustment will hold a public hearing at 5:30 pm on Tuesday, June 5th, 2018 in the City Council Chambers at the Butler City hall located at 22 West Ohio Street, Butler, Missouri, to review an application for a variance to allow the installation of a privacy fence that will be fourteen (14) feet from the property line parallel to the side street. This request comes from Tracy Jo Gernert for property that she owns at 5 South Olive Street in Butler, Missouri, for the following:

• The property owner proposes to allow the placement of a privacy fence that will be six (6) feet closer from the property line than the twenty (20) feet currently in the code. The variance is requested from the Zoning Regulations, Section 26-134 (e) in a Residential District.
• Legal Description: All that part of Block 61 in the ORIGINAL TOWN OF BUTLER, Bates County, Missouri, bounded and described as follows: Beginning at the Northwest corner of the South Half of Block 61 in the ORIGINAL TOWN OF BUTLER, Bates County, Missouri, and running thence North 70 feet, thence East 130 feet, thence South 45 feet, thence West 35 feet, thence South 25 feet, thence West 95 feet to the place of beginning.
• The property Address is 5 South Olive Street, Butler, Missouri 64730.
